In Hong Kong, licensing is mandatory for any corporation or individual engaging in regulated financial activities under the Securities and Futures Ordinance, SFO. A corporation must be licensed if it conducts regulated business locally, as outlined in Section 114.1 and 2. Even entities based outside Hong Kong must obtain a license if they actively market such activities to the Hong Kong public per Section 115. Additionally, individuals performing regulated functions for a licensed corporation or registered institution must themselves be licensed or registered as responsible officers, in accordance with Section 125.1a. These provisions ensure that all market participants meet regulatory standards safeguarding investor interests and maintaining financial integrity.
